An El Prado man was charged with homicide by vehicle after he crashed into a tree on Sunday (June 28) while driving on State Road 240 in Ranchos de Taos, killing a Taos woman who was riding with him.

New Mexico State Police officers responded to the crash around 7 p.m. Sunday night. They determined that Desiderio Garcia, 48, was driving when his vehicle left the roadway and struck the tree near Calle Martinez. His passenger, 39-year-old Lisa Marie Day was pronounced dead at the scene.

Officers determined that "alcohol was a contributing factor in the crash and seatbelts do not appear to have been properly utilized," according to a press release from state police public information officer Ray Wilson.

Garcia was arrested and booked into the Taos County Adult Detention Center on homicide by vehicle, which is a second-degree felony. Court records show that he had been charged on June 18 with driving with an open container, leaving the scene of an accident involving damage to a vehicle, failure to yield and no proof of insurance.

Taos Magistrate Court Judge Ernest Ortega imposed a $5,000 unsecured appearance bond for Garcia on Tuesday (June 30). Garcia is forbidden from consuming alcohol and has been fitted with a SCRAM unit, a device that measures a defendant's blood-alcohol content and notifies authorities if a defendant consumes alcohol. In the June 18 case, Judge Sara Blankenhorn imposed a $2,000 unsecured appearance bond.

The crash is still under investigation.
